Rental Agreement
This Rental Agreement (“Agreement”) is entered into between Days Off LLC (“Owner”) and the undersigned Guest (“Renter”) for a private excursion in Seattle, WA.
Master of the Vessel
A United States Coast Guard (USCG) certified captain is required as the Master of said vessel. The Renter can provide their own Captain, who will need to be approved on said vessel by Days Off LLC, and must provide proof of $500,000 in professional liability insurance prior to departure. If the renter does not have a suitable captain they can choose from captains provided by Days Off LLC during the rental request.
Indemnification: The Renter agrees to indemnify and hold harmless the Captain against any and all claims, suits, or liabilities, whether for damage to the vessel or property, or for the injury or death of any individuals, which arise from the negligence of the Captain or the failure of the Renter to fulfill their legal obligations as the Renter of the vessel.
Conduct and Safety Rules
We want you to feel at home! To keep the “Days Off” vibes going, we ask that you follow these simple guidelines:
- Smoking Policy: Smoking (including vaping) is strictly prohibited in the cabin and covered areas. Smoking is permitted only in designated outdoor areas or by the express, situational permission of the Captain.
- Keep it Legal (Illegal Activities & Marijuana Notice): No illegal substances or activities are permitted on board the Rental Craft at any time. Important: While recreational marijuana is legal in Washington State, the vessel operates on navigable waters subject to Federal Jurisdiction. The possession or consumption of marijuana on board is strictly prohibited by U.S. Coast Guard regulations. Non-compliance will result in immediate termination of the Rental without refund.
- The Captain’s Word: Our Captains are there to ensure your safety. The Captain has the final authority regarding the route, weather cancellations, and the authority to terminate the Rental immediately if the Renter or their guests engage in unsafe, unruly, illegal behavior or for any reason.
Arrival and Cancellation Policies
- Late Arrival Policy: The Rental period begins at the scheduled departure time. If the Renter or their guests arrive late, the cruise will still end at the originally scheduled time. No price adjustments or time extensions will be granted for late arrivals. If the Renter is more than 30 minutes late without notification, the Rental may be deemed a “No-Show” and cancelled without refund.
- Cancellation Policy: Things happen and we get it! Full refunds are offered if you need to cancel 24 hours prior to your trip. For less than 24 hours prior to your trip, we do not offer refunds. We operate rain or shine. We monitor the weather and make day-of determinations regarding safety. Should we decide to cancel your trip due to weather-related reasons, we will reach out to you on the day of your booking and discuss options to reschedule.
Damage Responsibility and “Loss of Use”
- Damage to Vessel: We take pride in our boat and ask that you do the same. The Renter assumes full financial responsibility for any damage caused to the vessel, its equipment, or furnishings by the Renter or their guests beyond normal wear and tear. This includes, but is not limited to, damage to upholstery, electronic equipment, and deck surfaces.
- Loss of Use: In the event that damage caused by the Renter or their guests results in the vessel being removed from service and unable to fulfill subsequent booked Rentals, the Renter shall be liable for “Loss of Use” damages. This will be calculated based on the daily Rental rate for each day the vessel is out of service for repairs.
Insurance Requirements
The Renter represents and warrants that they maintain adequate personal liability and/or property insurance to cover any injury to persons or damage to the vessel or property occurring during the Rental period. In the event the Renter does not have such insurance, or if such insurance is insufficient to cover the full extent of any injury or damage, the Renter agrees to personally bear all costs, expenses, and liabilities associated with such injury or damage.
Assumption of Risk, Waiver, and Indemnity
- Inherent Risks: The Renter understands and acknowledges that boating activities involve inherent risks, including but not limited to, changing weather conditions, movement of the vessel, slipping or falling on board, and risks associated with water-based activities.
- Voluntary Participation: The Renter and their guests are voluntarily participating in this Rental with full knowledge of the risks involved and hereby agree to accept any and all risks of injury, death, or property damage.
- Waiver and Release: To the fullest extent permitted by law, the Renter hereby releases, waives, and discharges Days Off LLC, its owners, employees, and contractors from any and all liability for personal injury, death, or property damage arising out of or related to the Rental.
- Indemnification: The Renter agrees to indemnify and hold harmless Days Off LLC from any and all claims, actions, suits, or costs (including attorney fees) brought by any guest or third party arising from the Renter’s conduct or the conduct of their guests during the Rental.
7. Media and Promotional Release
The Renter agrees that after consent any photographs, video, or audio recordings taken by Days Off LLC, or any contractor thereof, during the cruise may be used for promotional, marketing, or social media purposes. The Renter waives any right to royalties or compensation regarding such use.
